The petitioner apprehends his arrest in Itarhi P.S.Case No.267 of 2017 registered under Sections 341, 323, 504, 506, 354 and 34 of the Indian Penal Code.

The informant alleged that she had gone to attend the call of nature but the petitioner caught her hands with intention to out rage her modesty.

Learned counsel for the petitioner submits that prior to institution of the case the petitioner lodged Itarhi P.S.Case No.266 of 2017 against the father, Shyam Bihari Chaudhary and uncle of the informant and others for taking paddy from his field and when the petitioner objected Shyam Bihari Choudhary assaulted him.

Patna High Court Cr.Misc. No.17739 of 2018 (2) dt.05-04-2018 2/2 Three women who were sitting in the paddy field were also assaulted. It appears that there is a case and counter case. \ Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that Shyam Bihari Chaudhary is the father of the informant, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M.-II, Buxar, in Itarhi P.S.Case No.267 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
