JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 328 and 302/34 of the Indian Penal Code.

The prosecution case is that co-accused Amit Kumar and Ajit Kumar took the son of the informant namely Vikash Kumar on pretext of taking drink and breakfast when co-accused Ashok Sahni, with whom the informant has land dispute, administered poison by mixing in the liquor. Subsequently dead body of the son of the informant found in an orchard. Though, the petitioner was not named in the FIR but his name subsequently sprang up as one of the person who consumed liquor in the company of victim and others.

It is submitted by learned counsel for the petitioner that

Patna High Court Cr.Misc. No.42880 of 2015 (2) dt.15-10-2015 2/2 only on suspicion, the accusation has been levelled and the FIR named accused persons have been granted anticipatory bail vide Cr. Misc. No. 14717 of 2015. Moreover, the named accused Ashok Sahni has also been granted regular bail by the learned court below itself. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Begusarai in connection with Sahebpur Kamal P.S. Case No. 146 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
