2. The petitioner seeks bail in connection with Alamnagar (Ratwara O.P.) P.S. Case No. 166 of 2024 instituted for the offences under Sections 302, 120B of the Indian Penal Code and Section 27 of the Arms Act.
3. Earlier vide order dated 07.04.2025 passed in Cr. Misc. No. 12768 of 2025 regular bail of the petitioner was rejected by this Court considering the nature and gravity of offence.
4. In compliance of the order dated 24.09.2025 a report
Patna High Court CR. MISC. No.60369 of 2025(4) dt.14-11-2025 2/3 dated 07.10.2025 with regard to the present stage of trial has been received. From perusal of the aforesaid report, it appears that there are eight charge-sheeted witnesses but due to non appearance of two accused persons, charges have not been framed uptill now.
5. Learned counsel for the petitioner submits that the petitioner is languishing in judicial custody since 27.09.2024 without any rhymes or reason.
6. Learned APP for the State opposes the prayer for grant of bail.
7. There is no fresh ground to consider the bail petition of the petitioner.
8. In view of the above, the prayer for bail of the petitioner is again rejected with a direction to the court below to expedite the trial and conclude the same expeditiously as possible.
9. However, liberty is granted to the petitioner to renew his prayer for grant of bail after framing of charges.
10. The District Magistrate, Madhepura and the Superintendent of Police, Madhepura are also directed to ensure the presence of the witnesses/accused before the learned court below as and when required for expeditious conclusion of trial.

11. Let a copy of this order be communicated to the District Magistrate, Madhepura and the Superintendent of Police, Madhepura.
