2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. It is alleged that daughter of the informant was married with co-accused Prashant Kumar in the year 2007 and thereafter, she was subjected to torture by the family members for dowry. It is further alleged that co-accused Prashant Kumar had illicit relation with another woman which was protested by the deceased and due to which co-accused Prashant Kumar and other family members killed the daughter of the informant.

4. It is submitted that petitioner is not named in the F.I.R. Name of the petitioner surfaced during course of

Patna High Court CR. MISC. No.55130 of 2023(2) dt.23-08-2023 2/2 investigation in the confessional statement of co-accused Prashant Kumar. Petitioner is not a family member of the accused persons, he is only a co-villager and has got no concern with the affairs of the couple.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Bakhri P. S. Case No. 36 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
