JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 427, 504/34 of the Indian Penal Code. The prosecution case is that petitioner demolished the wall of the informant. On protest being made this petitioner assaulted with farsa on the head of the informant. When the father of the informant came to rescue then he was also assaulted.

It is submitted by learned counsel for the petitioner that injury has been found to be superficial, simple in nature. There is counter version of the occurrence and in the background of land dispute the accusation has been levelled. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the

No.44214 of 2015 (2) dt.29-10-2015 2/2 petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gopalganj in connection with Manjhagarh P.S. Case No. 109 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
