JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Barbigha P.S. Case No. 164 of 2016 registered under Sections47(a) of the Bihar Excise (Amendment) Act, 2016. Since, there is accusation that country-made liquor was recovered from Gumti of the petitioner; I am not inclined to release the petitioner on anticipatory bail and accordingly, his prayer for anticipatory bail in connection with Barbigha P.S. Case No. 164 of 2016 stands rejected.

However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
