JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 01-08-2017 This petition has been filed in public interest and the grievance of the petitioner is that the respondents have constructed a new sewage line in the eastern and western side of Chandmari Road, Kankarbagh Road, Patna in Ward Nos.29 and 35 in an unscientific and haphazard manner, thereby causing water logging and inconvenience to the citizens and public at large. Except for contending that the drainage has been constructed in an unscientific and haphazard manner and it is creating hindrance to the local

Patna High Court CWJC No.9863 of 2017 dt.01-08-2017 2/2 people, nothing is brought to our notice about the technical shortcomings, breach of specifications or expert opinion to show that the construction of the sewage or the road is contrary to the plan approved by the town planner or in violation of statutory provision. In case there is water logging in the area, it is for the petitioner to bring these facts to the notice of the Commissioner, Patna Municipal Corporation and we direct the Commissioner, Patna Municipal Corporation, to look into the grievance of the petitioner and take such steps as may be required and expedient for preventing water logging in the area during rainy season.
