JUSTICE SUDHIR SINGH ORAL ORDER 08-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 363 and 366A/34 of the Indian Penal Code.

Allegation against the petitioners is that they have kidnapped daughter of informant.

It is submitted on behalf of the petitioners that they have been falsely implicated in the present case. They are blood relation. From perusal of para-51 of the case diary it is evident that a false case has been instituted against the petitioners due to land dispute.

On behalf of the State, it is submitted that petitioners are named in the F.I.R. and subsequently the victim after recovery has also named these petitioners.

Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioners, same is

Patna High Court Cr.Misc. No.45069 of 2015 (4) dt.08-03-2016 2/2 rejected.

Any how, if petitioners surrender in the court below, i.e., Addl. Chief Judicial Magistrate, Danapur, Patna, in connection with Bihta P.S. Case no. 670 of 2013 within a period of six weeks from today and pray for regular bail, same shall be considered and disposed of preferably on the same day after taking into account the submissions made on behalf of the petitioners without being prejudiced by this order.
