The petitioner apprehends her arrest in Barauni (Chakiya) P.S. Case No. 128 of 2016 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.

The informant alleged that while he was talking with his brother Poras Razak, Binod Razak, Sunny Razak and the petitioner Shila Devi @ Sita Devi came and began to abuse. Binod Razak and Sunny Razak tied rope around the neck of the informant and dragged him to the road. When brother of the informant Poras Razak came to save Sunny Razak assaulted him with Katta on his head. Binod Razak and Sunny Razak began to strangulate the informant and the petitioner is alleged to have

Patna High Court Cr.Misc. No.28004 of 2016 (3) dt.04-10-2016 2/2 assaulted the informant with sickle.

It is submitted that there is a counter version. The injuries found on the person of the informant are superficial and simple in nature. No incised wound was found on scapula region of the informant, although the petitioner is alleged to have assaulted him with sickle on his shoulder.

Considering the facts aforesaid and the fact that the petitioner is a lady, she above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Barauni (Chakiya) P.S. Case No. 128 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
