The petitioner is aggrieved by an order dated 09.05.2022 by which the learned Principal Judge, Family Court, Vaishali at Hajipur has awarded a sum of Rs. 8,000/- by way of maintenance pendente lite in a divorce case filed by the petitioner/husband against respondent/wife bearing Divorce Case No. 72 of 2019.
3. It is an admitted position that the respondent/wife is not in a position to maintain herself and her minor child. It is also admitted that the petitioner is working in the Railways and his gross pay is Rs. 37,498/-.
4. Learned counsel for the petitioner submits that the petitioner has taken some advance due to which there is a
Patna High Court C.Misc. No.648 of 2022(2) dt.17-11-2022 2/2 deduction in his salary and the net salary is Rs. 20,464/-.

Taking into consideration the fact that the petitioner is a Central Government employee working in Railways having salary of Rs. 37,498/- and the fact that only Rs. 8,000/- has been awarded as maintenance pendente lite in favour of the wife which appears to be reasonable, accordingly, I do not find any reason to interfere with the order passed by the Family Court under Section 24 of the Hindu Marriage Act. Accordingly, this petition is dismissed.
