JUSTICE SANJAY PRIYA ORAL ORDER 06-04-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Srinagar (Pujaha) P.S. Case No. 8 of 2013 instituted for the offence under Sections 409, 420, 467, 468, 471 and 120(B) of the Indian Penal Code.
Learned counsel for the petitioner has submitted that earlier the case was investigated by the police and police has submitted Final Form vide Annexure-6 which was accepted by the court below. Later on, after calling for the report by Lokayukt from the Commissioner, the Commissioner directed for reinvestigation of the case. The police has taken steps for reinvestigation of the case after getting permission from the Court. It has further been submitted that re-investigation in the
Patna High Court Cr.Misc. No.12041 of 2018 (3) dt.06-04-2018 2/3 case is still pending.
Learned counsel for the petitioner has submitted that Mukhiya has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 23.12.2016 passed in Cr. Misc. 55455 of 2016 (Annexure-15). In such circumstances, the petitioner who is the Panchayat Rozgar Sewak is granted anticipatory bail till completion of further enquiry in the case by the police. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Srinagar (Pujaha) P.S. Case No. 8 of 2013, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, Distt. West Champaran, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
Patna High Court Cr.Misc. No.12041 of 2018 (3) dt.06-04-2018 3/3 of bail of the petitioner.
The petitioner will cooperate the police during further investigation. The petitioner will be at liberty to file fresh petition for anticipatory bail in the event petitioner apprehends arrest after submission of final report by Police after conclusion of further investigation.
The application stands disposed off.
