1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 303(2), 352, 351(2), 351(3) and 3(5) of the BNS.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that he was intercepted by the named accused persons including 4-5 unknown accused. Further, Suman Kumar assaulted the informant by tengari causing injury on his head. Thereafter, petitioner no. 2 assaulted Ram Janki Prasad Singh by an iron rod causing injury on his right side of the head while Biru assaulted by lathi causing injury on finger and Suman
Patna High Court CR. MISC. No.54313 of 2025(2) dt.21-08-2025 2/3 Kumar assaulted on his feet causing swelling thereafter petitioner no. 1 snatched his chain.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that petitioners are father and son and the injury suffered by Ram Janki Prasad Singh is simple in nature and the allegation of snatching chain against the petitioner no. 1 is ornamental. It is next submitted that petitioners are not the criminals and no motive has been assigned in the FIR for the occurrence. It is also submitted that from the side of the petitioners also Sarai Ranjan P.S. Case No. 25 of 2025 has been instituted against the side of the informant and others.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where
