JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 457/380 of the Indian Penal Code.

The prosecution case is that on theft being committed in the house of the informant, the FIR was registered against unknown. The name of the petitioner sprang up in the subsequent statement of the informant.

It is submitted by learned counsel for the petitioner that maliciously the petitioner being nephew of the informant has been implicated in this since the informant and father of the petitioner are cousin and the informant has opened a Mall, wherein the petitioner is working as an employee. There was some dispute with regard to payment of wages. The FIR was registered on

Patna High Court Cr.Misc. No.45060 of 2015 (2) dt.15-10-2015 2/2 15.09.2014 but the subsequent statement of the informant was recorded on 13.11.2014. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the delayed naming of the petitioner when the petitioner happens to be nephew of the informant, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhojpur, Ara in connection with Jagdishpur P.S. Case No.276 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
