2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 323 , 341 , 325 , 337, 307 and 34 of the Indian Penal Code and 27 of Arms Act 3 . As per the prosecution case , on the alleged date and time of occurrence ,when informant asked this petitioner to remove cattle from his share of land, upon which this petitioner along with other co-accused persons assaulted informant and his wife , as a result of which they sustained injuries and subsequently this F.I.R. was lodged.
4. Learned counsel for the petitioner submits that petitioner is own brother of informant and admittedly , there is land dispute between both the parties due to which an
Patna High Court CR. MISC. No.52761 of 2025(2) dt.27-08-2025 2/2 altercation took place between them. Case and counter case . Allegation of assault is general and omnibus against this petitioner. No specific overt act is alleged against this petitioner. Petitioner claims clean antecedent.
5 . Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts, general and omnibus allegation of assault against this petitioner, clean antecedent and circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM III Barh in connection with Bakhtiyarpur P.S. case No. 277 of 2024 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
