2. The petitioner apprehends arrest in connection with Kaimur (Bhabua) Prohibition and Excise PS Case No. 276 of 2026 lodged on 03.06.2026, for the offences punishable under Sections 30(a), 32(i)(iii) and 41(i)(ii) of Bihar Prohibition and Excise Act, 2018.

3. As per the prosecution, in total, 7.995 liters of illicit foreign liquor has been recovered from the motorcycle of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel further submits that the petitioner is having clean antecedent and at the relevant time and place of occurrence,

Learned counsel next submits that only due to the fact that the petitioner is the owner of the alleged seized motorcycle, his name surfaced in this case.

5. Learned APP for the State opposes the prayer for bail.

In the facts and circumstances of the case, let the above-named petitioner be released on bail, in the event of his arrest or surrender before the Trial Court within a period of four weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand only) each, as mentioned in Section 2(1)(d) of the Bharatiya Nagrik Suraksha Sanhita, 2023, to the satisfaction of the learned Spl. Judge, Excise Court No.-II, Kaimur at Bhabua, in connection with the aforementioned case, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023.
