JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 22-12-2021 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Bakhtiyarpur Police Station Case No. 97 of 2020, disclosing offences under Sections 341/427/353/307/34 of the Indian Penal Code.

The allegation against the petitioners is that they badly assaulted the informant and his family members.

No.9930 of 2021(2) dt.22-12-2021 2/3 The learned counsel for the petitioners has submitted that the informant and his family members badly assaulted the petitioners and their family members and in this respect petitioner No.2, Bihari Sada, has lodged Saharsa SC/ST P.S. Case No.9 of 2020. He has further submitted that the injuries sustained by the informant's side are simple in nature caused by hard and blunt substance except injuries sustained by Rajendra Yadav, who sustained one grievous injury caused by sharp cut weapon.

The allegation against petitioner No.2, Bihari Sada, is that he inflicted iron rod on head of Rajendra Yadav who sustained grievous injury, as such the anticipatory bail application of petitioner No.2, Bihari Sada, is rejected. Learned Addl. P.P. has opposed and the prayer for bail.

So far as rest petitioners are concerned, let the petitioner Nos.1, 3, 4, 5, 6, named above, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in
