ANJANA MISHRA ORAL ORDER 18-11-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners apprehend their arrest in connection with Gopalpur P.S. Case No. 171 of 2016 for the offences registered under Sections 304(B), 328, 201/34 of the Indian Penal Code.

Learned Senior counsel appearing on behalf of the petitioners submits that the petitioner no. 1 is mother-in-law of the deceased lady and petitioner no. 2 is the father-in-law, who is suffering from Cancer. In support of his submission, petitioners

have filed a supplementary affidavit placing on record the medical reports. Petitioner no. 3 is the Dewar of the deceased lady whereas petitioner nos. 4 and 5 are the co-villagers.

A perusal of the first information report itself does not speak of any specific allegation against any of them rather a general and omnibus allegation has been made against them. The Bhaisur and Gotani have been extended the privilege of anticipatory bail passed in Cr. Misc. No. 47363 of 2016 vide order dated 10.11.2016.

Considering the aforesaid facts and circumstances of the case and that these petitioners are other than husband, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M., 1st Nawgachhiya in connection with Gopalpur P.S.

Case No. 171 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
