Prayer is allowed.
Heard Mr. Ashok Jha, learned Advocate for the petitioner no. 2 and Mr. Ram Priya Sharan Singh, learned Additional Public Prosecutor for the State.
The petitioner no. 2 seeks bail in anticipation of his arrest in connection with Goraul P.S. Case No. 257 of 2020 dated 20.07.2020 instituted for the offences under Sections 341, 323, 324, 307, 354, 379 and 34 of the Indian Penal Code. The petitioner no. 2 is said to have assaulted the son
Patna High Court CR. MISC. No.9852 of 2021(2) dt.20-12-2021 2/3 and brother-in-law of the informant leading to simple injuries on their persons.
The mother of the petitioners has also filed a case against the informant and others vide Goraul P.S. Case No. 305 of 2020 in which some of the persons from the side of the petitioners have received injuries and about such injuries there is no explanation in the subject FIR.
The learned counsel for the petitioner no. 2 has submitted that an occurrence took place because of protest against the action of the brother-in-law of the informant having committed burglary in the dairy booth of petitioner no. 1 and the accusation in the subject FIR has unnecessary been overly exaggerated.
The parties are neighbours.
In fact, the informant is non-else but the aunt of the petitioners.
Regard being had to the aforestated facts the petitioner no. 2 (Ganesh Kumar @ Pappu Kumar Jha) is directed to be released on bail, in the event of his arrest or surrender before he Court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bond in the sum of Rs.10,000/- (rupees ten
