JUSTICE SANDEEP KUMAR ORAL ORDER 08-12-2021 At the very outset, learned counsel for the petitioner seeks permission to withdraw the present anticipatory bail application as against petitioner No. 1 (Yugal Kishore Sah). Permitted to be withdrawn.
It is, thus, dismissed as withdrawn as against petitioner No. 1.
Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with Bakhtiyarpur P.S. Case No. 205/2020 registered for the offences punishable under Sections 302/304(B)/34 of the
Patna High Court CR. MISC. No.10867 of 2021(1) dt.08-12-2021 2/2 Indian Penal Code and Section 3⁄4 of the D.P. Act. In view of the fact that petitioner No. 2 and petitioner No. 3 are the sister-in-law and brother-in-law of the deceased and considering the statement of the deceased that she wanted to marry someone else, but she was forcibly married in this family, the present anticipatory bail application is allowed. Accordingly, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Bakhtiyarpur P.S. Case No. 205/2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Sandeep Kumar, J) Saif/- U T
