The petitioner apprehends his arrest in Khajanchi Hatt P.S. Case No. 714 of 2015 registered under Sections 406, 409 and 420 of the Indian Penal Code.
The informant and eight other persons filed a written petition naming 13 persons as accused and alleged that in the year 2009, one Sun Shine Global Agro Limited Ford Company appointed the informant and others as agents of the company. The company got deposited money from the depositors. The maturity amount was paid up till 2012 but thereafter the depositors did not get their maturity amount and the accused persons fled away after closing the office of the company.

Patna High Court Cr.Misc. No.39898 of 2016 (2) dt.19-09-2016 2/2 of the company. The depositors did not make any allegation that how much amount has been misappropriated. However, the petitioner is ready to make payment to the depositors but since the SEBI has stopped the payment of the company, the maturity amount could not be paid to the depositors. It is further submitted that similarly situated co-accused Raj Gopal Pandey has already been granted anticipatory bail vide order passed in Cr. Misc. No. 19033/2016.
Considering the facts that same and similar allegation is made against the petitioner and the case of the petitioner stands on the same footing as that of Raj Gopal Pandey, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea, District Purnea in Khazanchi Hat P.S. Case No. 714/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
