Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Ahiyapur P.S. Case No. 592 of 2020, lodged under Sections 302/34 of the Indian Penal Code.

As per prosecution case, there are 2 persons who were made accused in the present case. There is no specific allegation against anyone and there is no eye witness of the occurrence but the dead body of the brother of informant was found in his house hanging there.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that antecedent of petitioner is clean and he is in

Patna High Court CR. MISC. No.53078 of 2022(3) dt.22-02-2023 2/2 custody since 06.05.2022. He also submits that there is no eye witness and the name of petitioner has figured in this case only and only on the basis of suspicion. Learned counsel for the petitioner further submits that petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him. Learned counsel for the State opposes the prayer for bail and submits that it is a case of circumstantial evidence and there is every likelihood that petitioner is involved in the commission of crime.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M, Muzaffarpur in connection with Ahiyapur P.S. Case No. 592 of 2020, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
