The petitioners, who are father and son respectively, seek bail in anticipation of their arrest in connection with Sheikhpura (Kushumba O.P.) P.S. Case No. 05/2018 dated 05.01.2018 instituted for the offences under Sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code. From the F.I.R., it appears that the informant was assaulted by co-accused Dhananjay Chaudhary and Laxman Chaudhary whereas his son Pankaj Kumar was assaulted by Tuntun Chaudhary and Sanjay Chaudhary. So far as the petitioners are concerned, they are said to have abused the female members of the house and divested some of them of their personal belongings. The cause of occurrence is stated to be a dispute over
Patna High Court Cr.Misc. No.15626 of 2018 (2) dt.05-04-2018 2/2 drainage of water. The petitioners are next door neighbours and as it has been submitted on behalf of the petitioners, the allegations have been exaggerated because of the existing dispute between them.
Considering the nature of accusation against the petitioners, they are directed to be released on bail, in the event of their surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bond in the sum of Rs. 10,000/- (Ten Thousand), with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura (Kushumba O.P.) P.S. Case No. 05/2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
