But no one is present on behalf of the opposite party to oppose this application. Even on 15.9.2015 the case was fixed on that date the opposite party was absent.

In such view of the matter, this Court is disposing of this application on its own merit.

In the present case a prayer has been made for transferring the Matrimonial Case No.265 of 2011 from the Principal Judge, Family Court, Nawada, to the Principal Judge, Family Court, Nalanda at Biharsharif. The Matrimonial case relates to grant of a decree of divorce against the petitioner who happens to be the legally wedded wife of O.P.

Patna High Court MJC No.311 of 2013 (4) dt.17-09-2015 2/2 It is very difficult for her to attend the Matrimonial case at Nawada. This Court is not giving any comment on merit. Looking to the aforesaid prayer and there is none to oppose the prayer of the petitioner, let the Matrimonial Case No.265 of 2011 pending before the Principal Judge, Family court, Nawada is transferred to the court of Principal Judge, Family Court, Biharsharif.

Accordingly, this application is allowed.
