JUSTICE ARUN KUMAR ORAL ORDER 07-02-2017 Heard learned counsel for the petitioners and the State.

Petitioners apprehend their arrest in connection with Dulhin Bazar P.S. Case No. 207 of 2015 registered under sections 364/34 of the Indian Penal Code. Subsequently, sections 302/201 IPC was added to the set of allegations.

Patna High Court Cr.Misc. No.39870 of 2016 (3) dt.07-02-2017 It is a case of kidnapping and murder. It is submitted that only on confessional statement of co-accused the petitioners were implicated and there is nothing against them. Other coaccused, namely, Umesh Yadav has been admitted to anticipatory bail by coordinate Bench of this Court and the case of the petitioners stands on similar footing.

Having considered the aforesaid facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the court concerned, let the petitioners, namely, Surendra Yadav and Ram Pravesh Singh @ Ram Pravesh Yadav be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Piyush Kumar Srivastava, learned Additional Chief Judicial Magistrate-III, Danapur, District-Patna in connection with Dulhin Bazar P.S. Case No. 207 of 2015, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
