02-07-2021 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Gopalpur P.S. Case No. 186 of 2019, registered for the offence under Section 392 of the Indian Penal Code.

As per the prosecution case, three unknown miscreants riding on two motorcycle snatched motorcycle, sum of Rs. 1000/- and mobile phone of the informant and fled away. Petitioner is not named in the FIR and it is submitted that only because of the fact that petitioner is accused in three more cases of similar nature, he has been made accused in this case. Till date, petitioner has not been put on T.I.P. and no material has come against the petitioner to connect him with the aforesaid crime. Similarly situated co-accused namely Golu

Patna High Court CR. MISC. No.15559 of 2021(2) dt.02-07-2021 2/2 Kumar has been granted bail by a coordinate Bench of this Court, vide order dated 13.11.2020 passed in Cr.Misc. No. 28919 of 2020. Petitioner is in custody since 02.09.2020. However, learned A.P.P. for the State opposed the bail petition and submitted that the case of petitioner is not identical to the case of co-accused Golu Kumar, who has been granted bail, since on the disclosure made by this petitioner, the stolen motorcycle was recovered from the house of Amresh Patel. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
