Mr.Nirmal Kumar Sinha ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-08-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Motihari Muffasil P.S. Case No. 562 of 2018, registered under Sections 406 and 420 of the Indian Penal Code. The accusation is that on receiving information about collection of Rs.500 to 1500/-, illegally, per labourer for providing them to job-card by this petitioner, informant being the Labour Officer, Motihari, inquired the matter and found that this petitioner illegally extorted the aforesaid money to the labourers.

Learned counsel for the petitioner submits that, in fact, petitioner being the member of Block Verification Committee had given an application on 25.06.2018, making

Patna High Court CR. MISC. No.53036 of 2019(2) dt.27-08-2019 2/2 allegation against the informant due to that reason petitioner has falsely been implicated in the present case and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Motihari Muffasil P.S. Case No. 562 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
