2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 147, 149, 341, 342, 325, 307, 504, 506 of the Indian Penal Code and section 27 of the Arms Act.
3. The prosecution case, in brief, is that on the alleged date and time of occurrence, petitioners and other co-accused persons are alleged to have assaulted informant and his son by means of lathi and danda due to which they sustained serious injuries.
4. Learned counsel for the petitioners submitted that the petitioners are innocent and have falsely been implicated in this case. The present case is counter blast of Atri P.S. Case No. 271/2020. Both sides sustained injuries. Injuries sustained by
Patna High Court CR. MISC. No.58123 of 2024(2) dt.18-09-2024 2/2 injured are simple in nature. Both the parties are gotias. Petitioners have no criminal antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the aforesaid facts and circumstances, and also there is no allegation of assault against these petitioners, the prayer for grant of anticipatory bail to the petitioners are allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned court of Additional Chief Judicial Magistrate-XIII, Gaya in connection with Atri P.S. Case No. 270 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Ranjeet/- U T
