JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 15-12-2022 Heard Mr. Mrigank Mauli, learned Senior Counsel assisted by Mr. Sanket for the petitioner, learned Additional Public Prosecutor for the State as well as learned counsel appearing on behalf of the informant.

The petitioner apprehends his arrest in connection with K. Nagar P.S. Case No.247 of 2022, registered for the offences punishable under Sections 420, 467, 468, 471, 385, 504, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as

It is further submitted that petitioner has purchased the land from Satish Choudhary and informant has purchased the same land from Pramod Choudhary. It is also submitted that Satish Choudhary and Pramod Choudhary are brothers.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Considering the facts that there is land dispute between the parties and the dispute is civil in nature, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnia in connection with K. Nagar P.S. Case No.247 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Anjani Kumar Sharan, J) Sanjay/- U T
