1. Heard learned Counsel for the petitioner, learned Counsel for the Opposite Party No. 2 and learned Additional Public Prosecutor for the State.
2. The present application has been filed by the petitioner for cancellation of bail granted to the Opposite Party No. 2, vide order, dated 17.02.2024, passed in Criminal Misc. No. 4792 of 2024, on the ground that the Opposite Party No. 2 was not complying the undertaking given by him before this Court inasmuch as the Opposite Party No. 2 is not ready to took her with him at his place of posting,
Patna High Court CR. MISC. No.58866 of 2024(10) dt.27-06-2025 2/2 i.e. Madhya Pradesh.
3. Pursuant to the earlier order, the petitioner as well as the Opposite Party No. 2 are present before this Court along with their respective Counsel.
4. On query, the petitioner has stated before this Court that she is living with Opposite Party No. 2 as husband and wife with full honour and dignity at the place of posting of Opposite Party No. 2. She has not made any complaint against the Opposite Party No. 2. She further submits that she is not willing to pursue this application.
5. Considering the above, this application is dismissed as having become infructuous.
