The petitioner apprehends his arrest in connection with Pranpur P.S.Case No. 123 of 2016 lodged under Sections 341, 323, 354 and 379/34 of the Indian Penal Code. The allegation, in brief, is that the accused persons entered into the house of the informant and assaulted her with lathi and rod. The specific allegation against this petitioner is that he torn off the blouse of the informant.
Learned counsel for the petitioner submits that due to land dispute, petitioner has been falsely implicated and the only specific allegation against him is that he outraged the modesty of the informant who is wife of his cousin moreover he has no criminal antecedent, except one another case earlier lodged by the
Patna High Court Cr.Misc. No.2181 of 2017 (3) dt.06-02-2017 2/2 informant of this case due to partition dispute. Considering the aforesaid facts and circumstances and the land disputes between the parties, the petitioner, namely, Md. Raju, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-I, Katihar, District-Katihar in connection with Pranpur P.S.Case No. 123 of 2016, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
