Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Lakhisarai P.S. Case No. 223 of 2020 registered for offence punishable under section 302/34 of the Indian Penal Code. The informant of this case is mother of the deceased Uday Shankar Kumar @ Baua.

As per allegation, the deceased Uday Shankar Kumar @ Baua was making protest against illicit relation between coaccused Rajeev Das and Baby Devi. When the deceased was

Patna High Court CR. MISC. No.9924 of 2021(4) dt.21-02-2022 2/3 sleeping in his Dalan, accused persons named in the F.I.R. including the present petitioner along with two unknown persons strangulated him to death.

The learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case, since he is brother of the co-accused Rajeev Das with whom the illicit relation of Baby Devi has been alleged in the F.I.R. He has further submitted that no evidence emerged during the course of investigation against the present petitioner and as such the Investigating Authority submitted the charge-sheet against other co-accused persons and not sent up the present petitioner.

Considering the above mentioned facts and circumstances, specially the fact that no evidence emerged during the course of investigation against the present petitioner and he was not sent up by the Investigating Authority, let the petitioner above named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 223 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.
