1. Heard learned counsel for the petitioner and the learned APP for the State.
2. Petitioner seeks regular bail in connection with Banshi P.S. Case No. 103 of 2022 dated 31.12.2022 registered for the offence(s) punishable under Section(s) 379 of the Indian Penal Code.
3. The main submissions advanced by the learned counsel for the petitioner are that the FIR was registered against unknown, and after investigation the police submitted final form showing this case having no clue but thereafter the alleged looted motorcycle was seized in connection with Wazirganj P.S. Case No.08 of 2023 registered under Section 414 of IPC and Section 30(1) of Excise Act and after that the police reopened the investigation of the present matter under Section 173(8) of
Patna High Court CR. MISC. No.54808 of 2023(2) dt.30-08-2023 2/2 the Cr.P.C. after getting permission from the court concern and finally the petitioner was chargesheeted in the present matter. Further submissions are that against the petitioner, there are criminal antecedents of three cases out of them he has got bail in two cases and the looted motorcycle which is stated to have been recovered in connection with Wazirganj P.S. Case No.08 of 2023, was not recovered from the conscious possession of this petitioner and he has been languishing in jail since 09.06.2023 in the present matter and against him, the investigation has been completed.
4. Learned APP appearing for the State has opposed the bail prayer.
5. Considering the above submissions and mainly the completion of investigation against the petitioner, this Court is inclined to accept his bail prayer. Accordingly, let the petitioner named-above be enlarged on bail in connection with Banshi P.S. Case No. 103 of 2022 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned. (Shailendra Singh, J) Sanjay/- U T
