2. Petitioner seeks regular bail in connection with Turkauliya (Banjariya) P.S. Case No. 802 of 2021 dated 15.10.2021 registered for the offences punishable under sections 302 and 326 read with section 34 of the Indian Penal Code.

3. The main submissions advanced by petitioner's counsel are that the petitioner is the wife of the deceased and the informant lodged the FIR merely on suspicion and later when she realized her mistake, she filed a compromise petition before the trial court, of which copy has been filed with this petition as Annexure - 'P/3' and during the course of investigation, some material witnesses, whose statements are mentioned in the paragraph Nos. 8, 9 & 10 of the case diary, clearly stated that on account of a dispute with regard to the Vidai of the petitioner from her parent's house, the deceased, in the spur of moment,

Patna High Court CR. MISC. No.59097 of 2025(4) dt.17-12-2025 2/2 poured petrol upon his body and set himself on fire, which resulted in his death during the course of medical treatment. It is lastly submitted that the petitioner, who is a lady, has fair and clean antecedent and has been languishing in jail since 04.03.2025 and against her, the investigation has been completed and one co-accused namely, Asagar Miyan, has been granted bail by a co-ordinate bench of this Court vide order dated 04.01.2023 passed in Cr. Misc. No. 42394/2022.

4. Learned APP for the State has opposed the prayer of the petitioner.

Considering the aforesaid submissions and mainly the petitioner's custody period, her fair and clean antecedent and the privilege of bail having been granted to the above mentioned co-accused and coupled with completion of investigation against her, this Court is inclined to release her on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Turkauliya (Banjariya) P.S. Case No. 802 of 2021.
