05-11-2015 Learned counsel for the petitioners is permitted to correct the Section mentioned in paragraph No.1 of the application in the course of the day.
Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners pray for anticipatory bail in a case registered under Sections 147, 148, 323, 341, 342, 353 and 504 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners were passing when a crowd had collected which had blocked the road in front of the house of the District Magistrate. It is further submitted that there is no specific allegation of brick batting against the petitioners, rather it is stated that one boy, whose name is not given in the first information report,
Patna High Court Cr.Misc. No.43286 of 2015 (2) dt.05-11-2015 indulged in brick batting on the police party, in which some boys succeeded in fleeing away. It is also submitted that none of the five motorcycles recovered belong to these petitioners. It is pointed out that the petitioners have no criminal antecedent On a consideration of the facts and circumstances of the case, it is directed that the petitioners (1) Chandan Kumar Singh and (2) Saurabh Gupta , in the event of their arrest/surrender in the court below within a period of four weeks from today, shall be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in connection with Bhagwan Bazar P.S. Case No.165 of 2014, subject to the other conditions as laid down under Section 438 (2) of the Cr.P.C. (Ramesh Kumar Datta, J) V.P.Sinha/- U
