The petitioner who is in custody since 11.04.2019 has filed the instant application for grant of bail in connection with Rail Katihar P.S. Case No. 32/2019 registered for the offence punishable under Section 414 of the Indian Penal Code and section 30(a) of Bihar Prohibition and Excise Act. As per the allegation in the FIR, the petitioner and two other persons were caught by the police and it is stated that about 10.08 litres of I.M.F.L. was recovered from the petitioner. It is submitted by learned counsel for the petitioner that the allegation as levelled in the FIR are false and concocted and he is in custody since 11.04.2019.

Having heard learned counsel for the parties and taking into consideration the petitioner being in custody since 11.04.2019 the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.,IInd, cum Special Judge, Katihar in connection with Rail Katihar P.S. Case No. 32/2019.
