ANJANA MISHRA ORAL ORDER 18-11-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner, being the married Nanad of the deceased lady, is apprehending her arrest in connection with Basopatti P.S. Case No.81 of 2016 (G.R. No.1090/16) for allegedly having committed the offence under Sections 304B/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner was married about seven years ago to one Bechan Mahto and was living with her husband and has no connection with the aforesaid case. As such, the petitioner may be extended the privilege of anticipatory bail.
Having heard learned counsel for the petitioner and
Patna High Court Cr.Misc. No.48425 of 2016 (2) dt.18-11-2016 2/2 the learned counsel for the State and on consideration of the facts and circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani, in connection with Basopatti P.S. Case No.81 of 2016 (G.R. No.1090/16), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
