The order impugned has been passed by Sessions JudgeAurangabad. There happens to be no whisper with regard to status of the aforesaid P.O. whether he happens to be presiding over the court of Special Court or exclusive Special Court in terms of Section 14 of the SC/ST (POA) Act.
In the aforesaid background, considering the observation made by the Division Bench vide order dated 17.02.2017 in Cr. Appeal (SJ) No. 832/2016, the appellants are directed to reagitate the matter before the competent court afresh and with the aforesaid direction, the instant memo of appeal is disposed of.
