JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 11-07-2017 Seeking an exception of the judgment dated 10.3.2017 passed by the learned writ court in C.W.J.C. No. 18496 of 2016, this appeal has been filed under Clause-10 of the letters patent. The appellant is the mother of two children who are studying in Central School, Muzaffarpur. An accident took place in said school whereby the children of the appellant are said to be brutally assaulted to one of the students namely, Uttam Kumar as reported by the Principal of the said school. Initially, the children of the appellant were suspended for ten days. The matter was tried to be closed but a Video pertaining to the incident became viral by some unknown persons. Thereafter, an FIR was lodged and criminal case was also instituted against the children of the
Patna High Court LPA No.662 of 2017 (2) dt.11-07-2017 2/2 appellant and they were sent to remand home. We find that learned writ court after taking notice of video and nature of incident has rightly interfered and stated that various serious issues involved in the matter with respect to administrative side of the school authorities till the issuance of transfer certificate. administrative side by the school authorities till the issuance of transfer certificate and as such, we are of the considered view that no error has been committed by the learned writ court. Therefore, appeal is dismissed.
