====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-08-2023 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 323, 324, 304(B)/34 of Indian Penal Code.

3. It is a case of dowry death.

4. Petitioner No. 1 is mother-in-law, petitioner No. 2 is Gotani and petitioner No. 3 is Nanad of the deceased.

5. It is submitted that petitioners have falsely been implicated in this case. Petitioners are separate in mess and property and they have got no concern with the family affairs of

Moreover, thrust of accusation is against husband of the deceased who has already been acquitted by learned Additional Sessions Judge-10, Samastipur vide S.T. No. 673 of 2022 dated 28.02/2023. Petitioners have got clean antecedent.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Samastipur in connection with Patory P. S. Case No. 145 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
