The petitioners apprehend their arrest in connection with L.N.M.U P.S. Case No. 7 of 2013 under Section 307 and other allied sections of the Indian Penal Code. The informant alleged against the petitioners that he went to Mohalla Azamnagar P.S. L.N.M.U. Distt. Darbhanga for executing the order of L.R.D.C., Darbhanga, bearing case no. 68/12-13 and shows the order of court below to Md. Nazir and his family members, then they began to quarrel and set ablaze his house and fire also caught in the house of Dropati Devi. They also started pelting the stones on police officials.
Patna High Court Cr.Misc. No.17858 of 2018 (2) dt.09-04-2018 2/2 Learned counsel for the petitioner submits that neither the petitioners are not named in the F.I.R.. Their names appeared during investigation but no specific allegation is made against them. Petitioner nos. 2 and 3 are wife and daughter of petitioner no. 1.
Considering the facts that petitioners are not named in the F.I.R. and their names figured during the course of investigation and no specific allegations are made against them, let the petitioners, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each in connection with L.N.M.U. P.S. Case No. 7 of 2013 to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
