Learned counsel for the petitioner is permitted to add Section 420 of the Indian Penal Code in first paragraph of the bail petition.

The petitioner apprehends his arrest in Dhansoi P.S. Case No. 114/2016, registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code. The petitioner is the Secretary of Kaithhar Kala and the allegation against him is that he did not submit the files, folders and registers with regard to the appointment of panchayat teachers in Kaithhar Kala panchayat.

It is submitted that the petitioner joined Kaithhar Kala on 26.06.2016 and his predecessor did not submit any paper with

Patna High Court Cr.Misc. No.46623 of 2016 (2) dt.02-12-2016 2/2 regard to appointment of panchayat teacher to him and that is why the petitioner did not submit any paper to the Block Education Officer, Rajpur Buxar.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Dhansoi P.S. Case No. 114/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
