The petitioner apprehends his arrest in connection with Dumariya Ghat P.S. Case No.81 of 2016/G.R. Case No.3897 of 2016 registered under Sections 272, 273 and 120-B of the Indian Penal Code besides Section 47(a) of the Excise (Amendment) Act. On receiving secret information about keeping of illicit liquor to sell at the house of the co-accused Nathuni Sahani of village-Semuapur, the police reached there. While two persons, on seeing the party, started to flee away but one was apprehended by the police, who disclosed his name as Nathuni Sahani and on search, 27 pouches, each containing 200 ml. illicit liquor, kept in a gunny bag, recovered from the hut of Nathuni Sahani. The

Patna High Court Cr.Misc. No.44155 of 2016 (2) dt.21-10-2016 2/2 apprehend co-accused Nathuni Sahani disclosed the name of the petitioner, who succeeded in fleeing away.

Learned counsel for the petitioner submits that the petitioner is not the family member of the co-accused Nathuni Sahani but with an ulterior motive, the petitioner has falsely been implicated in this case.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran, in connection with Dumariya Ghat P.S. Case No.81 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
