This is the third attempt of the petitioner to seek bail as earlier it was rejected by order dated 14.12.2021 in Cr. Misc. No.29399 of 2021 and by order dated 13.04.2022 in Cr. Misc. No.18202 of 2022, the petitioner was permitted to withdraw his bail application.

The learned counsel for the petitioner submits that out of 12 prosecution witnesses, 08 prosecution witnesses have been examined and the petitioner is suffering from ailment and his health has deteriorated and proper care is not being taken of the petitioner in the hospital.

The learned A.P.P. opposes the bail application. The Court is not inclined to exercise its jurisdiction

Patna High Court CR. MISC. No.53994 of 2022(2) dt.12-10-2022 2/2 for granting bail to the petitioner in the nature of allegation as alleged.

Accordingly, his prayer for bail stands rejected. However, the District Magistrate, Jamui is directed to ensure that the petitioner is given proper treatment, in the event, if he is suffering from health condition.

Let this order be communicated to the District Magistrate, Jamui forthwith.
