The petitioner is apprehending his arrest in connection with Sahajitpur P.S.Case No. 71 of 2015 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 47 of the Excise Act.

It has been submitted on behalf of the petitioner that nothing has been recovered from the possession of the petitioner and it is alleged that the vehicle of the petitioner at that time was given to the Driver.

Heard learned APP also.

Having heard both sides and considering the facts stated above, let the petitioner, Ajay Kumar Rai, in the event of his arrest or surrender in the court below within four weeks from the

Patna High Court Cr.Misc. No.952 of 2017 (3) dt.02-02-2017 2/2 date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.40,000/- (Rupees forty thousand) with two sureties of the like amount each to the satisfaction of Smt. Divya Shekhar, Judicial Magistrate, 1st Class, Chhapra, in connection with Sahajitpur P.S.Case No. 71 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the conditions that one of the bailors should be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further the petitioner will co-operate in the investigation and make himself available before the police/court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive dates, except showing some genuine ground, his bail bond shall be liable to be cancelled.
