JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 273 of the Indian Penal Code and Section 47(a)(f) of the Excise Act. 100 Kg of fragmented mahua flower was recovered from the petitioner.

It is submitted by learned counsel for the petitioner that alleged recovery has been made from the joint family house and co-accused Chhotan Chaudhary @ Chotan from whose possession 47 Kg fermented mahua was recovered, has been granted anticipatory bail vide Cr. Misc. No. 43729 of 2015.

The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Tekari P.S. Case No. 295 of 2015, pending in the Court of

Patna High Court Cr.Misc. No.44179 of 2015 (2) dt.29-10-2015 2/2 learned Judicial Magistrate, 1st Class, Gaya. With the observations above, the application stands disposed off.
