The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468 and 471/34 of the Indian Penal Code. The prosecution case is that the petitioner, Rameshwar Ojha, Onkar Ojha, Rakesh Ojha, Sitaram Ojha and Ajit Kumar Ojha enter into an agreement with the informant for transfer of land for total consideration amount of rupees twenty nine lakhs out of which rupees six lakhs was paid, one lakh each to each of the six accused persons. Subsequently the informant came to know that the accused persons have no share in the land.

No.45664 of 2015 (2) dt.03-11-2015 2/2 It is submitted by learned counsel for the petitioner that the agreement reflects that rupees four lakhs have been received by Onkar Ojha when Rameshwar Ojha, Lalpari Devi and Singhasan Devi have already executed sale deed in favour of the informant.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, West, Muzaffarpur in connection with Saraiya P.S. Case No. 186 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
