The petitioner apprehends his arrest in connection with Belhar (Kheshar) P.S. Case No. 194 of 2015, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 507, 332, 333, 353, 427, 283, 504 of the Indian Penal Code. Allegedly, the villagers of village Dhanuva, Khesar, Madhuvan and other villagers have blocked the road in front of the main gate of Khesar O.P., the police personnel and administration were trying to remove the blockage but in the meantime anti social elements and criminals attacked on the police personnel and damaged the vehicles. Patna High Court Cr.Misc. No.11334 of 2018(2) dt.28-02-2018 2/2 chaukidars identified the miscreants and named them. Submission is of false implication and that due to dirty village politics the petitioner has been implicated. Coaccused Pramod Mandal and others have been allowed prearrest bail vide Cr. Misc. No. 27023 of 2017 and the case of the petitioner is similarly situated and, as such, the petitioner deserves sympathetic consideration.
The learned A.P.P. fairly submits that other coaccused have been allowed pre-arrest bail. In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka, in connection with Belhar (Kheshar) P.S. Case No. 194 of 2015, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
