The petitioner seeks bail in a case registered for the offences under Section 379, 411, 427 of IPC read with Section 3 of Damage of Public Property Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 14.04.2021, charge-sheet has been submitted and has antecedent of two cases and the informant alleges that the petitioner was found cutting iron water tank of Irrigation Department and the petitioner also disclosed that he was cutting the iron water tank with a view to sell the same. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, further from perusal of seizure list, it would manifest that the same does

The learned A.P.P. opposes the bail application. Considering the fact that the petitioner is in custody since 14.04.2021, charge-sheet has been submitted and in the nature of allegation as alleged, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Abadpur P.S. Case No. 35 of 2021.

The application stands allowed.
