The stand of the State that since there is a ban imposed upon by the General Administration Department in holding any meeting for promotion etc., therefore, the claim of the petitioner has not been considered, is misplaced, for the simple reason that benefit of promotion, which the petitioner is looking for is under a special scheme, which is a stagnation scheme and not substantive promotion.
Even otherwise, the circular of the General Administrative Department, issued in October, 2014, has now lost its meaning in view of the decision already rendered by a Learned Single Judge as well as Division Bench of this High Court and no stay has been
Patna High Court CWJC No.3909 of 2014 dt.30-01-2016 2/2 granted on the SLP filed by the State before the Hon'ble Apex Court. Writ application is disposed off with a direction upon the respondents that the claim of the petitioner for second time-boundpromotion will be considered and a decision will be taken within a period of three months from the date of communication / production of a copy of this order.
