The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 304B/201/34 of the Indian Penal Code.
Allegation of commission of dowry death is against other co-accused, who are in-laws of the deceased. Allegation against the petitioner, who is a co-villager, is that he was involved in disposal of the dead body.
Submission is that just to be harassed, on suspicion the petitioner has been named. No one is the eyewitness of the occurrence.
Considering the aforesaid facts, the petitioner, above
Patna High Court Cr.Misc. No.45037 of 2016 (3) dt.19-01-2017 2/2 named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari/Successor Court in connection with Govindganj Police Station Case No.232 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
